We require payment to terms. Payment must be made on time, in full, and without any deduction, set off or counterclaim. In the event that an account is outstanding, we will refer the matter to our debt collection agent which will incur costs of 20% + vat. Any costs incurred to collect the debt will be added to the debt, plus VAT at the prevailing rate. You agree that you will be legally liable to pay us that surcharge, and that payment of the same can be enforced against you in court. You also agree to pay interest at the relevant reference rate provided for under the Late Payment of Commercial Debts (Interest) Act 1998 and subsequent amendments, which interest is payable both after and before any judgment of the court and continues to accrue.

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

In no case shall Smart Storage, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Smart Storage and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 15 – SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 16 – TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 17 – ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Terms and Conditions Relating to Installation of a Smart Storage Unit
In order to ensure that your installation goes ahead without issue, we require some essential information within 7 days of the sale in order to accommodate your chosen installation date. If you require further assistance in gathering this information, please do not hesitate to contact your Storage Expert who will assist you with any queries.
1. The dimensions of the under stairs space as shown below
2. A photo of your staircase clearly showing the space available beneath. Please ensure the lower and higher end of the staircase are visible, and that any items blocking the view of the staircase are removed.
3. If the space beneath the stairs is open, or if there is a doorway into the space allowing access, please take a photo clearly showing the inside of the staircase.
4. If applicable, we require a photo of any pipes, utility, gas or electricity metres located beneath the staircase. Please also measure the distance between the furthest protruding point of the metre or pipe to the front of the staircase.
Terms & Conditions
Please find attached to this email a PDF copy of your Order Confirmation. The Order Confirmation details your order including the unit type and any additional attachments. If you have trouble accessing this PDF copy, please contact your Sales Advisor and quote the reference number on this email.
Please note that we do not have a waste removal licence and are not registered to remove any waste generated from the installation of the Smart Storage unit. However, we will remove any rubbish we bring to site, and will leave any remaining debris in a neat manner to be later disposed of by yourself.
- Product colours may not accurately display on your monitor or screen.
- Images of storage units are for reference only. Your storage unit type, door width, skirting and architrave may vary depending on the angle of your staircase and space available.
- Tallboy sections are not lined out unless previously agreed with your sales person.
- Smart Storage units are provided in a primed matte white base. You can opt to paint the unit to your desired colour of choice should you wish to do so.
- Should you change flooring following the installation, Smart Storage will not take responsibility for adjusting your skirting, architrave or door height.
- Please ensure that children or minors are not left unsupervised in the home while your Smart Storage installer is on site.
- Our installers must have access to a parking space that is close to the front door and allows them visibility of their work van when working in the hallway. A lack of suitable parking may result in an us being unable to fit your Smart Storage unit.
- If a parking permit is required, it is the customer’s responsibility to organise this and to pay for this on the day of installation.
Completion of the Installation and Final Payment
On completion of the installation, the outstanding balance of the agreed price will be debited from the credit card or debit card provided. A deposit has previously been processed from the credit card or debit card provided when placing the order. The outstanding balance is set up to be paid in full on the next working day following the installation of the unit. Please Note: working days may vary slightly between the UK and Ireland depending on public holiday dates.
Changing your Method of Payment
Should you wish to use an alternative payment method, please contact your Sales Advisor. You must provide the chosen alternative method of payment five working days in advance of your scheduled fitting date. If additional costs are incurred due to late payment, Smart Storage is entitled to seek these costs. Should this situation arise, Smart Storage must provide proof of the additional costs incurred.
Your deposit is refundable, subject to the following Terms & Conditions applying;
- Should the installation not go ahead on the required date or on a subsequently agreed date
- Should the unit specified or an alternative unit not fit into the area
- Should you cancel within 48 hours of placing your order. All cancellations must be made in writing or by email to our Sales Office. Please quote your Order Number and Surname with the cancellation.
All refunds will be deposited back onto the original credit card or debit card as per the original order. Please allow up to 10 working days for the credit card or debit card company to process the refund. Please note that compensation will not be sought or paid, should the fitting date be changed by either party.
The full agreed price, as per the order value, must be paid in full prior to any claim or counter claim being made. Any claim for a contra-charge or discount must be submitted, in full, in writing to Smart Storage with full evidence, including, where applicable, photos, invoices, proof of payment and detailed breakdown of costs.
Should the parties be unable to agree on a resolution to the dispute, then the dispute must go to conciliation with an agreed appointed concilitor. The decision of the concilitor is final.
This dispute resolution procedure gives both parties specific legal rights, and you may also have other legal rights which vary from state to state under consumer protection law. This process neither impedes nor takes precedent to your consumer rights.
Payment must be received within 10 working days of the installation of your unit. We require payment to terms. Any costs incurred to collect the debt will be added to the debt, plus VAT at the prevailing rate. You agree that you will be legally liable to pay us that surcharge, and that payment of the same can be enforced against you in court. You also agree to pay interest at the relevant reference rate provided for under the Late Payment of Commercial Debts (Interest) Act 1998 and subsequent amendments, of which interest is payable both after and before any judgment of the court and continues to accrue. Please note that late and non-payment may also affect your warranty guarantees. The storage unit(s) fitted remain the property of Smart Storage until payment in full is made. Should payment not be received in full, Smart Storage reserve the right to remove the whole or partial unit from your home and reasonable access must be provided by the customer to do so.
The warranty is valid for 24 months from the date the storage unit was supplied and installation was completed to our recommended and minimum standards by Smart Storage fitters. This warranty gives you specific legal rights and you may also have other rights which vary from state to state under consumer protection law. This warranty neither impedes nor takes precedent to your consumer rights.
Please note that the warranty is non-transferable. This warranty covers any defects in materials or workmanship resulting in the unit not functioning as a storage device and restricting it from its normal function of opening and closing, with the following exceptions stated below.
– Where overloading in excess of the 35kg weight restriction per drawer has taken place.
– Misuse or 3rd party damage and / or interference.
– Decoration or decorative issues, including fading or colour changes. The unit comes in a matte white primed coat, and can be painted to match your décor.
– Workmanship is excluded when installation is not supplied by Smart Storage fitters.
– Where payment in full for the price quoted has not been received for the product and service within 10 working days of the installation date, or an alternative date agreed in writing in advance of installation.
The warranty does not cover the following:
– Fading or discoloration caused by exposure to sunlight or chemicals such as ammonia, laundry detergent or household bleach.
– Damage resulting from misuse or overloading of the drawer mechanism.
– Decorative details or interior styling changes.
What Smart Storage Will Do
Smart Storage will repair any part of the storage unit that proves to be defective in materials or workmanship. In the event that repair is not possible, Smart Storage will either replace the part or compensate you with a new part of similar composition and price.
